IDX or MLS Listings — Images

Roberto Carlos Paredes PA shall have no liability with respect to the images and content on the Roberto Carlos Paredes PA website, and shall be released and held harmless with respect to any issue that may arise from images that are outside the control of Roberto Carlos Paredes PA. In the event of an issue with images or content placed on the Roberto Carlos Paredes PA website that appear as a result of MLS/IDX listings or through any third party, any legal matter concerning the IDX or MLS listing image must be addressed with the third party that placed such image or content on the IDX or MLS system.

Accordingly, any person seeking legal recourse shall indemnify and hold harmless Roberto Carlos Paredes PA and its affiliates from and against any and all losses, liabilities, claims, charges, actions, proceedings, demands, judgments, settlements, costs and expenses (including, without limitation, attorneys’ fees and expenses) that Roberto Carlos Paredes PA or its affiliates may incur as a result of, or arising in any way from, the use of the IDX/MLS listings by Roberto Carlos Paredes PA.

Text Messaging Terms

Roberto Paredes Realtor SMS messaging: updates on new property listings, market trends and upcoming events.

You can cancel the SMS service at any time. Simply reply “STOP” to any of our messages. When you send “STOP”, we will confirm your unsubscribed status by SMS. After this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially and we will resume sending you SMS messages.

Carriers are not liable for delayed or undelivered messages.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Strategic Calculator and Private Analysis Tools

Access to the Strategic Calculator and to any private analysis tool is granted through personal credentials (email and PIN) after a consultation with Roberto Carlos Paredes PA. By creating your access and by signing in, you accept these Terms in their entirety, and that acceptance covers all subsequent use of the tool, including — without limitation — the calculations you run, the assumptions you edit and any document, report or PDF you export, download, print or share from the tool.

Nature of the figures. All figures, metrics (including cash-on-cash, cap rate, gross yield and break-even occupancy), rental projections, appreciation and sale scenarios are hypothetical and illustrative, calculated with assumptions that you control and can edit. They are not predictions, they do not constitute financial, tax, legal or investment advice, and actual results may differ substantially, including the partial or total loss of the capital invested.

Third-party rental programs. No projection in the tool is based on the performance, track record or promises of any rental, hotel management or leasing program (“rental program” or “leaseback”) offered by a developer or operator. Such programs are independent contracts between the buyer and third parties; information about them must be requested directly from the relevant operator.

Exported documents. Every document generated by the tool retains this illustrative character even when it circulates outside the tool. If you share a report with third parties, they may not treat it as advice, a recommendation or an offer from Roberto Carlos Paredes PA, and any use by third parties is the sole responsibility of the person who shares it.

Credentials. Your access is personal and non-transferable. You are responsible for keeping your PIN confidential and for all activity carried out with your credentials. Access may be suspended or revoked at any time.

Arbitration and Class Action Waiver

Any dispute, claim or controversy arising out of or relating to these Terms or the use of the Service shall be resolved by final and binding individual arbitration, rather than in a court of law, except that a claim may be brought in small claims court if it meets the applicable requirements. You and Roberto Carlos Paredes PA mutually waive the right to a jury trial and the right to participate in any class, representative or consolidated action.

The arbitration will be administered by the American Arbitration Association (AAA) under its rules then in effect, and will take place in Miami, Florida, USA. The governing law will be the law of the State of Florida and the U.S. Federal Arbitration Act. The arbitrator’s award will be final and enforceable in any court of competent jurisdiction.

If this arbitration clause is held unenforceable by a court of competent jurisdiction, any litigation must be brought exclusively in the courts of Miami-Dade County, Florida, and both parties submit to that exclusive jurisdiction.

Artificial Intelligence — Use and Limitations

Roberto Carlos Paredes PA uses artificial intelligence (AI) tools to improve the user experience, including indicative projections in the Strategic Calculator, assistance with communications and analysis of market trends. By using our tools, you accept and acknowledge the following:

DMCA Policy — Copyright

We respect the intellectual property rights of others. If you believe that any content published on this website infringes your copyright, you may notify our Designated DMCA Agent under Section 512 of the U.S. Digital Millennium Copyright Act (DMCA).

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 15 days’ notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
